Preble Co. Officials Getting Death Threats

DAYTON, Ohio (WDTN) - David Scott of Tennessee entered eight not guilty pleas in federal court Thursday. He is accused of threatening to torture and kill a handful of Preble County officials, including Sheriff Mike Simpson.

According to court documents, Scott called Preble County investigator David Lindloff, eight times this year, leaving threatening messages. In the records, federal investigators said that Scott told Lindloff, "I'm going to get you, Lindloff. I'm going to brutally torture (you)."

The affadavit also accuses Scott of saying that Lindloff, Sheriff Simpson and other officials, "deserve to be lined up against a wall and shot, but only after they're tortured."

Sheriff Simpson said once the calls began threatening the officials' families too, they called the FBI.

The Scott family has a long history with the Preble County justice system. David Scott's brother, Billy, was convicted of killing Lesa Marie Buckley in July 1990, and the family has been fighting the jury's decision ever since.

"We've been working on this for 18 years and we've gotten nowhere," said Scott family friend, John Moran. "Billy Scott is innocent. Preble County framed him."

"Whether you agree or disagree with what happens in court, the judicial system or whatever the case may be, you cannot threaten public officials," said Sheriff Mike Simpson.

Moran said he cannot confirm or deny what was said between Scott and county officials.

"I think they're going to find him innocent of that and send him on his road, and we're going to get Billy out and get the right people behind bars," said Moran.

Scott was allowed to return to his home in Tennessee, but he is required to wear a GPS monitoring device, and has been ordered to turn in his phone records each month so the court can monitor who he calls.

I have not heard from the Scott family for quite some time, and so cannot suppose to know the circumstances, motives, methods, or truths behind this story. It would be wonderful to have them active on this board and perhaps one day we will together revive the threads that were begun long ago at TalkEaton.com.

However, I have had my own interactions with Lindloff in the Consolidated Rd. triple homicide, and I can certainly understand why he would receive death threats. In my own case, he was so out of line that I filed a complaint about him with the Preble County Sheriff's Office during the investigation the year following the homicides. When I recently wrote asking for a copy of that complaint, I never received one and I would not be surprised if that document has disappeared as have so many other documents in my case. Fortunately, I was able to relay my Lindloff experience with OBCI and hopefully they obtained a copy of that report.

There are many other Lindloff incidents reported by others that I am unable to discuss here (but which have been handed over to federal authorities). And there are quite a few Lindloff incidents which are testified to and/or documented on this very board. After all the threats and underhanded things this man has perpetrated, he has a lot of nerve complaining about harrassment...

From our David Lindloff thread ( triplehomicide.proboards.com/index.cgi?board=justice&action=display&thread=20 ) I have selected a few partial posts to bring to this thread so that it is more obvious what kind of an official he is and that he himself is no stanger to threats.

I have several contacts from citizens alerting me to threats they have received from this man in particular, but at this point they have requested confidentiality of me, which I always honor. One has been documented in a written report to the Preble County Sheriff's office, and I know of at least one other that was reported to FBI agents when they were actively seeking information in the triple homicide case. One account came to me as a terrified whisper from someone who has already suffered untold horror.

... When I got put in jail I was kept in a cell away from all other inmates. They wouldn't let me make bail for several days. The second day I was in jail the door to my cell was opened. Standing their was a deputy and another officer David Lindloff, he works out of the Prosecuting Attorney Office. He asked me about how I like my cell. The other deputy stayed outside. Lindloff asked me about the Buckley case. I said nothing to him. I was told to forget everything I knew about the case if I knew what was good for me. During our conversation I was informed that the camera was off. ...

... Many times Lindloff tried to get me to meet him outside of his offices, he was very intimidating and scared the hell out of me. ... After several meetings, Lindloff finally told me "why do I even care, my husband died with another woman". It was a sick thing to say to a new widow... After a phone discussion with Lindloff last month, he continues to wildly try to veer off on other avenues to avoid directly answering specific questions.

Though Preble County officials are quick to say they are willing to look in to anything the public may want to present to them, the above instances have all been documented and yet David Lindloff continues to hold several official positions within Preble County and likely continues the above activities as well.

Sheriff Mike Simpson sums up David Lindloff's actions and Dave Scott's resulting threats like this...

"Whether you agree or disagree with what happens in court, the judicial system or whatever the case may be, you cannot threaten public officials," said Sheriff Mike Simpson.

I do not think that anyone would argue that threats ... whether from officials or from battered and suffering citizens ... are alright, but these threats from a citizen who has dealt with years of tactics from Preble County officials is a clear example of the stress and extreme mental, emotional, and physical duress and harm put upon anyone who dares to question why their loved one has been harrassed, framed, or even murdered.

There are (at least) two sides to every story ... it is a shame that David Lindloff's past actions were not brought to light in the media as David Scott's threats were being lambasted across the county and beyond ...

Scott going to prison for threats

The brother of a Preble County man convicted of murder in 1992 has been sentenced to federal prison after repeated threats to a public official.

On Oct. 22, David Scott of Mt. Juliet, Tennessee, was sentenced in United States District Court, Southern District of Ohio (Dayton) to one year and one day in the custody of the United States Bureau of Prisons, having plead guilty to one count "Sending Threatening Communications in Interstate Commerce."

The charge was based upon Scott's interstate use of his telephone to make multiple threats of serious bodily harm and death to a public official.

"Public officials in the criminal justice system, whether they be police officers, prosecutors, investigators, or judges, perform a very difficult and vital role in keeping our communities safe from violent crime," Preble County Prosecuting Attorney Marty Votel said. "These officials must feel confident that they can vigorously and ethically investigate, prosecute, and sentence criminals without fear of retribution from those who may be aggrieved by the outcome of criminal proceedings."

David Scott is the brother of Guy Billy Scott.

In 1992, Guy Billy Scott was convicted by a jury of aggravated murder - among other charges - in the death of Lesa Marie Buckley. The case was prosecuted by the Preble County Prosecuting Attorney's office which employed David Lindloff as a prosecutor's investigator.

According to a release from the Preble County Prosecutor's Office, the Scott family has for years maintained that Guy Billy Scott was wrongfully convicted of the crime. Beginning in January 2009 and continuing for the next several months, David Scott made a series of 30 phone calls to Lindloff, who is still employed by the Prosecutor's Office.

On many occasions, he left angry messages suggesting that Lindloff had been actively engaged in "framing" Guy Billy Scott for the murder of Lesa Buckley, and threatening Lindloff with death and serious physical harm, including being "skinned alive."

"I'm just calling to tell you to let you know that your days are getting numbered, baby," Scott said in one of the messages he left Lindloff at his office. "I'm going to get (expletive) revenge for what you did on Consolidated Road. I'm going to get revenge for what you did to the Buckley family and most of all, I'm going to get revenge for what you did to Billy Scott. I'm going to cut layers of fat off you and watch you die screaming."

Scott continued, "I'm full of anger and I'm full of revenge and I'm going to get you ... I want you and I'm going to get you."

The threats were reported to the Federal Bureau of Investigation. Subsequent investigation traced the calls to David Scott's cell phone in Mt. Juliet, Tennessee. David Scott was contacted and admitted to making the threats. Because the threats to a public official were made across state lines using telecommunications equipment, the federal authorities gained jurisdiction over the offense.

"The conviction and sentence of David Scott demonstrates that there are effective laws addressing the intimidation of public officials, and that there should be - and is - a "zero tolerance" policy in Preble County when it comes to enforcing these laws. This is the only way to ensure that the criminal justice system will continue to work effectively on behalf of our citizens," Votel said.

I think many here know the level of frustration that Mr. Scott was driven to.

I pray that David was just blowing off steam and would not carry through with these threats.
